1. Services Offered

The Newsletter Crew offers marketing and campaign support services, including:

  • Dedicated newsletter promotions

  • Kickstarter and Indiegogo campaign features

  • Paid ads management (Meta, Google)

  • Consulting and strategic planning

  • Referral tracking and performance analysis

Services may be customized depending on client needs and availability.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use our services.

3. Service Process

To engage our services, clients typically:

  • Complete an inquiry form or email introduction

  • Participate in a discovery call or correspondence

  • Provide assets such as copy, visuals, campaign links, and brand details

  • Review and approve materials prior to launch

We reserve the right to accept or decline projects based on alignment, quality, or availability.

4. Payment Terms

  • Services must be paid for upfront unless a written agreement provides otherwise.

  • We accept payments via Wise, Stripe, or bank wire transfer.

  • Invoices must be settled within 3–5 business days of issuance.

Unpaid invoices may result in delays or cancellation of the scheduled service.

5. Refund Policy

A. General Policy – All Sales Are Final

Unless otherwise stated in writing, all purchases are non-refundable. This includes:

  • Newsletter placements

  • Ads campaign management

  • Consulting calls

  • Promotional audits or strategy work

We do not provide refunds for dissatisfaction with campaign results, lack of client response, missed launch windows, or third-party platform issues (e.g., Kickstarter performance or email open rates).

B. Guaranteed Campaigns

If a written funding goal guarantee is made before the service begins (typically for Kickstarter/Indiegogo clients), and the campaign fails to reach its funding goal, we may issue a full refund minus third-party fees, subject to:

  • Proof of guarantee in writing (email or contract)

  • Timely delivery of assets and approvals by the client

  • No misrepresentations or campaign violations

If no such guarantee was provided in writing, no refund will be granted.

C. Partial Refunds or Credit (Discretionary)

Partial refunds or credit toward future services may be issued in the following rare cases:

  • Duplicate payments

  • Internal scheduling errors on our part

  • Agreed cancellations before work begins

Approved refunds will be processed within 10 business days.

D. Refunds Will Not Be Provided For:

  • Delays or errors caused by client inaction

  • Missed approvals or campaign deadlines due to lack of communication

  • Change of mind or pursuit of alternative promotion services

  • Platform issues outside of our control

  • Unused services once scheduled and resourced

E. Disputes & Chargebacks

Clients are expected to contact us at hello@enewslettercrew.com before initiating chargebacks. Fraudulent or abusive chargebacks will result in service suspension, potential legal action, and blacklisting from future campaigns.

6. Client Responsibilities

Clients must:

  • Submit timely and accurate materials

  • Ensure product claims are truthful and legally compliant

  • Approve drafts promptly before scheduled delivery

  • Follow Kickstarter/Indiegogo platform rules

We are not liable for delays or issues caused by missing materials or client inaction.

7. Intellectual Property

  • You retain all rights to your submitted content.

  • You grant us a non-exclusive license to use your materials for service delivery.

  • Custom newsletter and ad content created by us remains our intellectual property unless agreed otherwise in writing.

8. Confidentiality

We will treat all client materials and communications as confidential unless disclosure is required by law. You agree not to disclose pricing, strategies, or proprietary tools without our written permission.

9. Limitation of Liability

We are not liable for indirect or consequential damages, including:

  • Loss of expected campaign funds

  • Platform-related performance issues

  • Technical errors beyond our control (e.g., email delivery, ad platform bugs)

Our maximum liability is limited to the amount paid by the client for the service in question.

10. No Guarantee of Results

While we aim to deliver results, marketing outcomes depend on various external factors. Unless specifically guaranteed in writing:

  • We do not guarantee a specific number of backers or conversions

  • No assumptions of results should be made based on past client success stories

11. Data Collection & Privacy

We may collect limited data for:

  • Internal analytics

  • Service optimization

  • Client communication

We do not sell or share personal data with third parties, except when required to deliver services (e.g., email or ad platforms). Please refer to our Privacy Policy for more details.

12. Termination of Service

We may suspend or terminate service access for:

  • Breach of these Terms

  • Fraud or abuse

  • Failure to pay invoices

  • Offensive, illegal, or harmful behavior

No refunds will be issued for terminated services unless legally required.

13. Dispute Resolution

We aim to resolve disputes through open and informal communication first. If a resolution cannot be reached, all disputes shall be governed by the laws of the State of Montana, United States, and subject to the exclusive jurisdiction of the courts located in Kalispell, Montana.

14. Amendments
